Terms of Service
These Terms govern your use of the FoodieRow platform. By creating an account or using the platform, you agree to these Terms. FoodieRow may update these Terms at any time — continued use of the platform after updates constitutes acceptance of the current posted version.
1. What FoodieRow Is
FoodieRow is an online marketplace that connects mobile food vendors with event organizers. We are a platform — not a party to any agreement between vendors and organizers, not an employer of vendors or organizers, not an insurer, not a financial institution, and not a government compliance authority.
When an organizer posts an event and a vendor applies, any working arrangement is between those two parties. FoodieRow provides the tools, protections, and processes to help both sides connect, but we do not guarantee any specific outcome for either party.
2. Account Eligibility
To use FoodieRow, you must:
- Be at least 18 years old
- Have legal authority to enter into agreements on behalf of yourself or your business
- Provide accurate, current, and complete information during registration
- Keep your account credentials secure and not share them with others
- Use the platform for lawful business purposes only
FoodieRow reserves the right to verify your identity, business status, or submitted documents at any time. Providing false information is grounds for immediate account suspension.
3. Organizer Responsibilities
By posting on FoodieRow, organizers agree to provide accurate, complete, and timely information about their event. This includes — but is not limited to — event dates, location, electrical and water access, expected attendance, vendor slot availability, payment structures, and any applicable fees.
Organizers are responsible for obtaining all required venue permissions, city and county permits, health department clearances, fire marshal approvals, and any other governmental or venue-required authorizations. FoodieRow does not obtain or verify these on your behalf.
Organizers must not contact or book vendors discovered through FoodieRow outside of the platform. Off-platform circumvention violates these Terms and may result in account suspension. See our Marketplace Protection Policy for details.

4. Vendor Responsibilities
Vendors using FoodieRow are independent business operators. You are solely responsible for maintaining all required licenses, health permits, liability insurance, food handler certifications, vehicle permits, sales tax certificates, and any other documentation required by your city, county, state, or venue.
FoodieRow collects and organizes compliance documents to help streamline event participation, but we do not certify, verify, or guarantee that your documents meet the requirements of any specific event, venue, city, or jurisdiction. Final approval authority rests with the organizer, venue, or applicable government body.

5. Protected Contact & Marketplace Rules
Vendor and organizer contact information is protected on FoodieRow until platform unlock rules are satisfied. Contact details may only be shared through FoodieRow's system after the appropriate stage (such as shortlisting or approval) is reached.
Users who attempt to circumvent the marketplace — by contacting, contracting with, or booking parties discovered through FoodieRow outside of the platform — violate these Terms. FoodieRow may suspend or permanently remove accounts engaged in off-platform circumvention.

6. Fees & Payments
FoodieRow charges fees for certain platform actions, including vendor application fees and organizer event posting fees. For organizer-paid gigs, a platform fee applies to the committed vendor budget.
FoodieRow does not take a percentage of a vendor's sales at any event. Platform fees apply only to specific platform transactions (application fees, posting fees, and organizer-committed vendor budgets), not to event-day revenue earned by vendors.
For events using the “Vendor Pays to Vend” payment model, FoodieRow may collect booth or vending fees from vendors through Stripe on behalf of organizers. These fees are held by FoodieRow for event protection and are not immediately transferred to the organizer. See our Payment Policy for details on how held booth funds are reviewed and released.

7. No Guarantees
FoodieRow does not guarantee:
- That vendors will receive bookings or event approvals
- Any specific level of attendance, foot traffic, or sales at any event
- That organizers will fill all vendor spots
- That any document will be approved by a local authority or venue
- That any permit, license, or insurance will be accepted by the applicable authority
- Uninterrupted platform availability at all times
- That vendor or organizer information submitted is accurate
FoodieRow is a platform tool. Real-world success depends on the quality and preparedness of each party, local conditions, weather, venue requirements, and many other factors outside our control.
8. Prohibited Conduct
You may not use FoodieRow to:
- Submit false, misleading, or fraudulent information in any profile, application, or posting
- Contact or transact with other parties discovered through FoodieRow outside of the platform
- Post fake reviews, ratings, or testimonials
- Harass, threaten, defame, or discriminate against other users
- Scrape or collect data from the platform without authorization
- Attempt to gain unauthorized access to any user's account or FoodieRow systems
- Misrepresent your identity, business, or qualifications
- Violate any applicable local, state, federal, or international law
- Use the platform for anything other than its intended business purpose
9. Suspension & Removal
FoodieRow reserves the right to suspend, restrict, or permanently remove any account that violates these Terms, our policies, or that poses a risk to other users or the platform. We may act without prior notice in cases of fraud, abuse, repeated violations, or legal obligation.

10. Disputes Between Users
FoodieRow provides tools and processes to help resolve post-event disputes, including our confirmation and payout review workflow. However, FoodieRow is not an arbitration body and our decisions are made at our discretion as a platform operator, not as a legal authority.

11. Intellectual Property
All content, branding, and technology on FoodieRow is owned by FoodieRow or its licensors. You retain ownership of content you submit (profiles, photos, event descriptions), but you grant FoodieRow a non-exclusive, royalty-free license to display and use that content for the purpose of operating the platform.
You may not copy, reproduce, scrape, or redistribute FoodieRow's platform, listings, or content without written permission.
12. Limitation of Liability
To the maximum extent permitted by law, FoodieRow is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or damages resulting from vendor no-shows, event cancellations, permit denials, payout delays, or any actions or omissions of other users on the platform.
Our total liability to any user for any claim arising from use of the platform is limited to the fees paid by that user to FoodieRow in the 12 months preceding the claim.
13. Policy Updates & Governing Law
FoodieRow may update these Terms at any time. When we do, we will update the effective date at the top of this page. Continued use of the platform after changes are posted constitutes your acceptance of the updated Terms. If you disagree with any change, your remedy is to stop using the platform.
These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.
